1. WHAT INFORMATION DO WE COLLECT?

We collect information from and about users of the Services:

Order Information: Each time you place an order or subscribe for the Service, this information will be added to your account and our orders database (if you are an unregistered user). We will also use this information to improve our Service and customer success services. In addition, we will anonymize the personal information included in orders or subscriptions when you request a deletion or when your account becomes inactive to continue to use this information in an anonymized form to optimize our services. For these purposes we may collect your order history, invoices, order ID, subscription term, etc.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Subject to applicable law, including but not limited to our obligations under the applicable laws, we may license, sell, or otherwise share aggregated, de-identified versions of your data and other data (“De-identified Information”) with our subsidiaries, affiliates, partners, customers, investors, providers, and contractors for any purpose. You agree and acknowledge that Bizmated is the sole and exclusive owner of any De-identified Information created by Bizmated and that you have no ownership or other intellectual property rights in or to such De-identified Information. This De-identified Information can also be included in the machine learning model based on which our service operates.

Third-Party Information Collection

When you use the Site or its content, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include:

 analytics companies;

 payment providers;

 our hosting and other web service providers;

 your mobile device manufacturer;

 your mobile service provider.

These third parties may use tracking technologies to collect information about you when you use this Site and Service. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties tracking technologies or how they may be used, and we do not monitor your interactions with third parties. Any interactions you have with third parties are solely your responsibility. If you have any questions about an advertisement or other targeted content, you should contact the provider responsible directly. We do not control the privacy practices of websites or applications that we do not own. Users are encouraged to read the privacy notice or policy of those properties to make an informed decision regarding their use of them.

Cookies and Other Tracking Technologies

We may use cookies, their alternatives and other tracking technologies (like web beacons and pixels, etc.) to access or store information. When you visit or use our Site we may register your IP address, browser type, operating system, referring website, your general geographic location as indicated by your IP address, web-browsing behavior, and whether and how you interact with content available on our Site and within our Service. We use different methods to collect this information, including our own cookies, third-party cookies, and other tracking technologies.

Do-Not-Track

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected.

We do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

We would like to remind you that it is your responsibility to ensure, to the best of your knowledge, that the data you provide us with is accurate, complete, and up to date. Additionally, if you share or store data of other people in our Services, it is your responsibility to collect that data in compliance with local legal requirements. For example, you should inform those individuals whose data you provide to us about the content of this Privacy Notice and obtain their prior consent.

As a user of the Service, you acknowledge and guarantee that during your usage term, you:

Bizmated may send you regular promotional communications about their products, services, events, and promotions. We may also contact you regarding information, products, services, events and promotions from Bizmated as well as from other third-parties providers of products and services complementing our products and services that we believe can be relevant to you because of your usage of our products or to expand your functionality; mainly when we find this third-party has specific services or solutions to meet your needs, or to optimize your use of our products and services. We will not share your registration data with our trusted partner unless we have sufficient grounds to do so.

When permitted and/or required by applicable law or where we have your consent, to be able to tailor the communications to your preferences and behavior and provide you with the best, personalized experience, we may analyze and combine all information associated with your data and data about your interactions with us. We may also use this information to create segments of our audience showing which of our products and/or services users are interested in and track the success of our marketing efforts. We may keep records of whether you open our electronic communication, as well as the links you click on our electronic communication.

Opting out of marketing and promotional communications

If you object to the processing of your personal information for direct marketing purposes, the relevant personal information shall no longer be processed for such purposes. You will then be removed from the marketing lists. If we use or share your data differently than we have listed above, we will ask your permission when we collect the personal information.

Bizmated primarily conducts business with users located within the USA, but is available worldwide, including the EEA. If you choose to use the Site and Services from the EEA, your personal information may be transferred from the EEA to the USA under the EU-U.S. Data Privacy Framework (DPF).

Additionally, we may transfer your personal information from the EEA to other countries or regions as part of the technological process involved in providing the Service to you. By providing any information on our Site, including personal data, you consent to these actions.

4. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice unless a longer retention period is required or permitted by law. No purpose in this Privacy Notice will require us to keep your personal information for longer than the period in which users have an account with us.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

All information you provide to us is stored on secure servers located in the USA. If international data processors are involved, we will implement appropriate technical and legal safeguards to ensure that you receive the same level of protection as provided by the EU-U.S. Data Privacy Framework (DPF).

Where we have given you (or where you have chosen) a password that enables you to access certain parts of the Site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

In Short: You may review, change, or send requests for opt-out of processing, deletion your personal information at any time.

For US residents

In certain states in the United States, privacy laws have been enacted that require specific disclosures and provide certain rights. Under these circumstances, you may have some or all the following rights in relation to your personal data, as stipulated by data protection laws.

Right to Access and Know: You can request access to your personal information (commonly known as a “data subject access request”). This allows you to receive a copy of the personal information we hold about you and verify that we are lawfully processing it.

Right to Request Correction of Your Personal Information: You can request the correction of any personal information we hold about you. This allows you to have any incomplete or inaccurate data corrected, although we may need to verify the accuracy of any new data you provide.

Right to Request Deletion of Your Personal Information: You can request the erasure of your personal data. This enables you to ask us to delete or remove personal information where there is no legitimate reason for us to continue processing it. You also have the right to ask us to delete or remove your personal information where you have successfully exercised your right to object to processing, where we may have unlawfully processed your information, or where we are required to erase your personal information to comply with local law. However, please note that we may not always be able to comply with your request for specific legal reasons, which we will inform you of, if applicable, at the time of your request.

Right to Opt-out of Processing: You can object to the processing of your personal information when we rely on a legitimate interest (or that of a third party) and there is something about your particular situation that makes you want to object to processing on this ground, as you believe it impacts your fundamental rights and freedoms. You also have the right to object when we process your personal information for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information that override your rights and freedoms.

Right to Impose Restrictions on the Processing of Your Personal Data: You can request the restriction of the processing of your personal data. This allows you to ask us to suspend the processing of your personal information in the following scenarios:

 If you want us to establish the accuracy of the data;

 When our use of the data is unlawful, but you do not want us to erase it;

 When you need us to retain the data even if we no longer require it, as you need it to establish, exercise, or defend legal claims;

 If you have objected to our use of your data, we need to verify whether we have overriding legitimate grounds to use it.

Right to Data Portability: You can request the transfer of your personal information to yourself or to a third party. We will provide your personal information to you, or the third party you have chosen, in a structured, commonly used, machine-readable format. Please note that this right only applies to automated information that you initially provided with your consent for us to use or where we used the information to fulfill a contract with you.

Withdrawal of Consent: You can withdraw your consent at any time if we rely on our consent to process your personal data. However, this will not affect the lawfulness of any process carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will inform you if this is the case when you withdraw your consent.

Right to Opt-out of Sharing for Cross-Context Behavioral Advertising: You can request to opt out of the sharing of your personal information for the purposes of cross-context behavioral advertising.

Right to Appeal: You have the right to appeal our denial of your request(s).

California Privacy Disclosure

The California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) provide specific rights to California consumer residents regarding their personal information, also referred to as personal data. This section describes your CCPA/CPRA rights and provides instructions on how to exercise them. Please note that the following does not apply to de-identified or aggregated personal data, or data that is publicly available.

We do not respond to “Do Not Sell” requests as we do not sell your personal information to third parties. In the twelve months before the effective date of this Privacy Notice, we have not sold any personal information of Customers, as per the definition of the CCPA/CPRA. After receiving your opt-in consent, we sometimes disclose personal information collected via cookies for cross-contextual behavioral advertising purposes, which may qualify as sharing your personal information under the CCPA/CPRA. To opt out, you can adjust your cookie preferences on our website to block our advertising cookies, or you can change your device settings to block cookies or install a third-party plugin to control how cookies interact with your device.

We will not discriminate against you for exercising your rights under the CCPA/CPRA.

Based on the complexity of the request and the applicable regulations, we may charge a fee for your request. We may offer a CCPA/CPRA-permitted financial incentive, participation in a financial incentive program requires your prior opt-in Consent, which you may revoke at any time.

Nevada Privacy Notice

If you are a Nevada resident, under Privacy and Security of Personal Information Chapter of the Nevada Revised Statutes Section 603A (“603A”), we are required to provide notice that Bizmated does not sell personally identifiable information and does not have plans to start.

Virginia Privacy Disclosure

The Virginia Consumer Data Protection Act (hereafter “VCDPA”) provides Virginian consumer residents who reside in Virginia with specific rights regarding their personal information. In addition to the general privacy notice, this section supplements it, describes your VCDPA rights and explains how to exercise those rights.

The following does not apply to de-identified or aggregated personal information or data publicly available.

As a Virginia resident, you have the following rights, subject to some exceptions, regarding your personal information effective as of January 1st, 2023:

 Right to Confirm if a Controller is processing your personal information and to access personal information;

 Right to Correct inaccurate personal information;

 Right to Delete;

 Right to Obtain a copy of personal information in a portable format;

 Right to Opt-Out of the processing of personal information for purposes of targeted advertising, sale, or profiling with legal or other significant effects;

 Right to Appeal – Consumers have the right to appeal a controller’s (i.e., business) denial to act within the time outlined in the VCDPA.

We do not respond to “Do Not Sell” requests as we do not sell your personal information to third parties. In the twelve months before the effective date of this notice, we have not sold any personal information of customers, as per the definition of the VCDPA.

After receiving your prior consent, we sometimes disclose personal information collected via cookies for cross-contextual behavioral advertising purposes, which may qualify as sharing your personal information under the VCDPA. To opt out, you can adjust your cookie preferences on our website to block our advertising cookies, or you can change your device settings to block cookies or install a third-party plugin to control how cookies interact with your device.

Access and Update: You can review and change your personal data by logging into the Site and visiting the edit user account page (if applicable). You may also request access and notify us through the contact information below of any changes or errors in any personal data we have about you to ensure that it is complete, accurate, and as current as possible. Please note that we may not be able to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect. Restrictions: You have the right to restrict the processing of your personal data under certain circumstances. You can request we restrict our use of it if you contest its accuracy, if the processing of your personal data is determined to be unlawful, or if we no longer need your personal data for processing, but we have retained it as permitted by law. Portability: To the extent the personal data you provide Bizmated is processed based on your consent, you have the right to request that we provide you a copy of, or access to, all or part of such personal data in structured, commonly used, and machine-readable format. You also have the right to request that we transmit this personal data to another controller, when technically feasible. Withdrawal of Consent: To the extent that our processing of your personal data is based on your consent, you may withdraw your consent at any time by closing your

account and deleting the Site. Withdrawing your consent will not, however, affect the lawfulness of the processing based on your consent before its withdrawal, and will not affect the lawfulness of our continued processing that is based on any other lawful basis for processing your personal data. Please note, that the De-identified Information used to train and build the machine learning model will indirectly use the De-identified Information you gave us. We can exclude them only to the extent technically possible. Right to be Forgotten: You have the right to request that we delete all your personal data. We cannot delete your personal data except by also deleting your user account, and we will only delete your account when we no longer have a lawful basis for processing your personal data or after a final determination that your personal data was unlawfully processed. We may not accommodate a request to erase information if we believe the deletion would violate any law or legal requirement or cause the information to be incorrect. In all other cases, we will retain your personal data as set forth in this notice. In addition, we cannot completely delete your personal data as some data may rest in previous backups and machine learning models. Complaints: You have the right to lodge a complaint with the applicable supervisory authority in the country you live in, the country you work in, or the country where you believe your rights under applicable data protection laws have been violated. However, before doing so, we request that you contact us directly to give us an opportunity to work directly with you to resolve any concerns about your privacy. How You May Exercise Your Rights: You may exercise any of the above rights by contacting us through any of the methods below and through the live chat feature of our Site. If you contact us to exercise any of the foregoing rights, we may ask you for additional information to verify your identity. We reserve the right to limit or deny your request if you have failed to provide sufficient information to verify your identity or to satisfy our legal and business requirements.

However, please note that this will not affect the lawfulness of the processing before its withdrawal, nor when applicable law allows, will it affect the processing of your personal data conducted in reliance on lawful processing grounds other than consent.

Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can delete your account via the Site or contact us using the contact information provided.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms, and/or comply with applicable legal requirements.

The data protection legislation gives you the right to access information held about you. Your right of access can be exercised in accordance with the applicable laws.

8. MINORS

In Short: We do not knowingly use children’s personal information in any manner.

The Site and Service is not intended for persons under 13 years of age, and we do not knowingly collect information from persons under 13 without verification of parental consent. If we learn we have collected or received information from a person under 13 without verification of parental consent, we will delete that information.
